On October 26, 2023, the Administrative Board of the Western Interregional Territorial Branch of the Antimonopoly Committee of Ukraine issued a decision recognizing the existence of a conspiracy between FOP Cherepanyn L.Ya. and FOP Petrychkovich G.B. during their joint participation in the procedure of purchasing services for the organization of hot meals for students of grades 1-4 and students of preferential categories of the Stryi specialized school No. 4 I-III century (Lviv region). The purchase, with an expected cost of UAH 579,490, was announced by the school in 2019.
The department proved that FOP Cherepanyn L.Ya. and FOP Petrychkovich G.B., during the preparation and participation in the auction, contrary to the Law of Ukraine “On Public Procurement”, coordinated their behavior. On the basis of the established facts, the administrative board of the Western MTV recognized the actions of the defendants as a violation of the legislation on the protection of economic competition, which led to the distortion of the results of the auctions. L.Ya. Cherepanin for conspiracy against FOP. and FOP Petrychkovich G.B. fines in the amount of 25,000 hryvnias were imposed on each.
As a reminder, according to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for committing anti-competitive concerted actions related to the distortion of tender results during the last three years .
