On September 28, 2023, the Administrative Board of the Western Interregional Territorial Branch of the Antimonopoly Committee of Ukraine recognized the existence of a conspiracy between the limited liability company “Tartovy Dim “Tantal” and the limited liability company “Tantal” during their preparation and participation in the procedure for the purchase of enamel pipes for the State Enterprise “Lvivcoal” “.
The total expected purchase price is UAH 945,000.
During the consideration of the case, the department found out that the defendants, in violation of the Law of Ukraine “On Public Procurement”, coordinated their behavior, in particular, it was established that there were telephone connections between them, conducting business at common addresses, and that their employees were related by family relationships .
Based on these and other facts, the administrative board of the Western MTV recognized the actions of both companies as a violation of the legislation on the protection of economic competition, in the form of anti-competitive concerted actions that led to the distortion of the results of the auctions.
A fine of 68,000 hryvnias was imposed on “Tantal” Limited Liability Company and “Tantal” Limited Liability Company for conspiracy.
We would also like to remind you that, according to the Law of Ukraine “On Public Procurement”, the reason for refusing to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for committing anti-competitive concerted actions related to distortion during the last three years results of tenders.
