On October 12, 2023, the administrative board of the Western interregional territorial branch of the Antimonopoly Committee of Ukraine recognized the existence of a conspiracy between the limited liability company “Atacraftis” (at the time of the auction – Zakhistprom Trade LLC) and the limited liability company “Ekonochrum” (at the time of the auction – Stensis Capital LLC) during their preparation and participation in the procurement procedure for the lot “Regenerative cartridge for training self-rescuer 1T1 and 1T2”. The state enterprise “Lvivvugillia” acted as the customer of the purchase.
The expected cost is UAH 3,674,000.
During the case review, the department found out that the defendants coordinated their behavior contrary to the Law of Ukraine “On Public Procurement”. On the basis of the discovered evidence, the administrative board of the Western MTV recognized the actions of both companies as a violation of the legislation on the protection of economic competition in the form of anti-competitive concerted actions that led to the distortion of the results of the auctions.
A fine of UAH 27,000 was imposed on “Atacraftis” LLC for conspiracy, and UAH 68,000 on “Ekonochrum” LLC.
According to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for anti-competitive concerted actions related to the distortion of tender results during the last three years.
