Resident of Pustomyty District to Stand Trial for Systematic Violence Against Mother
Prosecutors from the Pustomyty District Prosecutor’s Office have filed an indictment in court against a 37-year-old local resident for acts of domestic violence (Article 126-1 of the Criminal Code of Ukraine).
Case Details
Investigation has established that the accused systematically committed psychological violence against his 61-year-old mother. Specifically, he insulted her with obscene language and threatened physical harm. All this led to psychological suffering and a deterioration in the woman’s quality of life.
- Previously, the man had been repeatedly held administratively liable for such actions (Article 173-2 of the Code of Administrative Offenses).
- A court ruling banned the offender from staying at the shared residence with the victim for 6 months. However, he continued to live in his mother’s house and persistently committed domestic violence against her.
Thus, under public prosecution, the prosecutors had the man found guilty for failing to comply with the prohibition set by the restraining order (Article 390-1 of the Criminal Code of Ukraine) and sentenced him to 1 year of restricted freedom. The court’s ruling comes into legal force after the appeal period expires.
Investigation
The pre-trial investigation was conducted by investigators from Police Department No. 3 of Lviv District Police Department No. 2, Main Directorate of the National Police in Lviv Region.
Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subject to criminal punishment until their guilt is proven in accordance with the law and established by a guilty verdict of the court.
