State registrar illegally re-registered ownership of real estate worth almost UAH 1.3 million – to be tried
Prosecutors of the Frankivsk District Prosecutor’s Office in Lviv have sent to court an indictment against the state registrar of one of the city councils in Lviv region. He is charged with unauthorised alteration of information processed in automated systems or stored on the carriers of such information, committed by a person who has the right to access it and abuse of authority (Part 3 of Article 362, Part 3 of Article 365-2 of the Criminal Code of Ukraine).
The investigation established that the state registrar, with the aim of obtaining an unlawful benefit, made unauthorised changes to the State Register of Real Property Rights in relation to real estate objects.
These are the buildings of a bathhouse-laundry and a boiler room with a total area of almost 680 sq m, located in Lviv.
In particular, knowing that the real estate was seized by the court, the defendant made registration changes and registered the ownership of this property in the name of another individual. At the same time, he illegally changed the individual registration number of the real estate object, which had been assigned earlier.
As a result of such actions, the real estate was unlawfully withdrawn from the ownership of the rightful owner. Its estimated value is almost UAH 1.3 million.
The pre-trial investigation was carried out by investigators of the Police Department No. 1 of the Lviv District Police Department No. 2 of the Main Directorate of the National Police in Lviv Region.
Note: In accordance with Article 62 of the Constitution of Ukraine, a person shall be presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
