The Lviv Court of Appeal recognized as well-founded the arguments of the prosecutors of the Lviv Regional Prosecutor’s Office regarding the claim from the private property of an individual in favor of the Lviv Regional State Administration of a plot of land with an area of more than 0.15 hectares in the village of Bryukhovychy near Lviv. The cost of the mentioned plot is over UAH 3.8 million.
At one time, the prosecutor’s office discovered an illegal decision of the Bryukhovytsia settlement council, by which the indicated plot of land was transferred to private ownership.
The prosecutor’s office established that the village council unlawfully disposed of state-owned lands that belonged to the Cabinet of Ministers of Ukraine and were transferred for permanent use to one of the state-owned enterprises.
Subsequently, the privatized plot was resold several times, including to the defendant in this case.
According to the lawsuit of the Lviv regional prosecutor’s office, the Shevchenkivskyi district court of Lviv satisfied the claims regarding the claim of a land plot with a total area of 0.1543 ha from private property in favor of the state.
As a result of the appellate review of the specified case, the arguments given in the defendant’s appeal regarding the legality of ownership of the disputed land plot were rejected, and it was decided to claim it in favor of the state.
