After that, the woman turned to the state registrar, who, as a result of manipulations in the state registers, unjustifiably indicated that a basement with an area of 6.8 square meters was part of her apartment. m, which never belonged to this apartment.
In addition, the defendant turned to one of the project LLCs with a request to divide her apartment, to which a basement had just been added, into separate objects – an apartment and the same basement.
Therefore, on the basis of the conclusion that it was made by the specified limited liability company, information about the division of real estate into a separate apartment and a basement was entered into the state register. But the area of the basement as a result of “re-planning, re-measurement and clarification” is changing and already amounts to 80.7 square meters. m.
In this way, the defendant illegally took possession of the remaining non-residential premises with an area of 74.7 square meters. m, which remained in the basement of the building and were not privatized, except for those 6 square meters. m, which, we remind you once again, were legally purchased by her.
Therefore, the court supported the position of the prosecutor’s office and returned the specified premises to the ownership of the Lviv community.
