Former village head and current deputy suspected of unlawful transfer of land plot worth over UAH 1 million to a citizen
Under the procedural supervision of the Yavoriv District Prosecutor’s Office, the former head of one of the village councils of Yavoriv district, and now a current deputy of one of the city councils of the district, was served a notice of suspicion. He is accused of abuse of office and forgery (part 2 of Article 364, part 1 of Article 366 of the Criminal Code of Ukraine).
According to the investigation, in November 2020, the suspect, being the head of the village council, illegally transferred ownership of a land plot to a citizen.
The man received permission from the village council to prepare a land management project. When the project was ready, the land plot was registered in the State Land Cadastre and assigned a cadastral number.
However, the cadastral number was assigned at a time when the village council in question was already included in the Novoyavoriv territorial community, and therefore the decision to approve the project and transfer the land to this citizen should have been made at a session of the Novoyavoriv City Council.
Nevertheless, the village head issued a retroactive decision and voting protocol, on the basis of which the citizen illegally registered his property right to the land.
As a result of such actions of the official, a 1.8-hectare land plot was illegally withdrawn from the communal property of the territorial community.
The value of the land is over UAH 1 million.
The pre-trial investigation is being carried out by investigators of the Yavoriv District Police Department of the Main Department of the National Police of the region, based on the materials of the SBU Office in Lviv region.
Note: In accordance with Article 62 of the Constitution of Ukraine, a person shall be presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
