A resident of Lviv Oblast was sentenced to 3 years behind bars for evading military conscription

A 38-year-old resident of Zaporizhzhia was found guilty of evading conscription for military service during mobilization (Article 336 of the Criminal Code of Ukraine) in the court of appeals after a public indictment by the prosecutors of the Lviv Regional Prosecutor’s Office.

Previously, by the decision of the district court, the defendant was sentenced to 3 years behind bars, but was released from serving the sentence with a probationary period of 2 years.

The prosecutors did not agree with this position and filed an appeal.

It was established that in March 2022, the man temporarily lived in the Lviv region, where he received the summons.

The conscript was fit for military service. However, the accused expressed his disagreement to the territorial recruitment and social support center for mobilization and refused to be sent to the army, about which a relevant act of refusal was drawn up.

Taking into account all the circumstances, the Lviv Court of Appeal supported the position of the prosecutors and sentenced the man to a new sentence of 3 years of imprisonment.
