Following the principled position of the Yavoriv District Prosecutor’s Office, the court of appeal upheld the decision of the Commercial Court. In particular, the claims against the business entity to remove obstacles to the use and disposal of the water fund land plot were upheld by returning it.
We are talking about a site worth more than UAH 4.7 billion located on the territory of the Yavoriv territorial community. The latter has a reservoir with a total area of over 130 hectares.
It was established that the company had been using the reservoir for a long time without title documents to carry out fishing activities, making a profit. At the same time, the company did not enter into a lease agreement and did not pay rent.
The use of a water body with the water fund lands occupied by it contrary to the procedure established by law is contrary to the interests of the state in the field of efficient and rational use of natural resources.
In response to the violation, the prosecutor’s office filed a lawsuit with the court, which was fully satisfied.
To date, the court decision has been enforced – the land plot with the reservoir has been returned to the actual ownership, use and disposal of the city council.
