Nearly 3 Hectares of Land with a Pond to Be Returned to the Community in Yavoriv District

The Yavoriv District Prosecutor’s Office successfully filed a lawsuit against a private citizen and a government body to annul property rights to a land plot and return it to communal ownership.

The case concerns a land plot of nearly 3 hectares located within the Shehyni Territorial Community. The plot includes a pond covering 2.8 hectares.

Investigations revealed that, based on a district administration order, a woman unlawfully acquired ownership of this land along with an unsealed artificial pond. However, the plot was transferred under the guise of agricultural land (arable land) as recorded in the State Land Cadastre. According to the law, only sealed natural water bodies can be privately owned.

To protect the community’s interests, the Prosecutor’s Office filed a lawsuit in the district court, which was fully satisfied.

After the court’s decision comes into legal force, steps will be taken to ensure its prompt enforcement.
