Prosecutors ensure return of water fund land plot to hromada in Zolochiv region
Water fund land plot of 17 hectares returned to Krasnenska community
The Zolochiv District Prosecutor’s Office ensured the actual enforcement of the decision of the Economic Court of Lviv Region to restore the community’s right to a water fund land plot.
It is a plot with a total area of more than 17 hectares, which is located outside one of the villages of the Krasnenska territorial community of Zolochiv district.
It was established that the disputed plot is located in the coastal protection zone of the Western Bug River. According to the current legislation, its designated purpose should be water fund land with the appropriate category.
For a long time, the above-mentioned plot belonged to state ownership, but without establishing a protective zone of the river’s coastal protection strip. Despite the fact that it is located close to a water body, it was unlawfully assigned the category of agricultural land.
In addition, this land plot was formed without taking into account the size of the coastal protection zone, which may be significantly larger.
Incorrect accounting of land has a negative impact on its further disposal. Accordingly, the latter are subject to restrictions on their withdrawal as water fund lands.
Given the violation of the law, the prosecutor’s office defended the interests of the state and filed a lawsuit to remove obstacles to the use and disposal of water fund lands, which was fully satisfied.
To date, the court’s decision has been enforced, information has been entered into the State Land Cadastre to cancel the state registration of the land plot, and the land has been returned to the community.
