Prosecutors of the Pustomyty District Prosecutor’s Office have sent to court an indictment against the state registrar of one of the territorial communities.
She is charged with abuse of power and unauthorized actions with information processed in electronic computers, automated systems, computer networks or stored on the carriers of such information, committed by a person who has the right to access it (Part 1 of Article 365-2, Part 1 of Article 362 of the Criminal Code of Ukraine).
The investigation established that in the period from December 2021 to February 2022, the state registrar illegally registered ownership of 11 apartments in Solonka village to individuals without proper legal grounds.
For undue advantage, the accused made unauthorized changes to the State Register of Real Property Rights. In particular, without obtaining information from the Unified Electronic System in the field of construction on the commissioning of a real estate object, technical inventory and assignment of an address to the real estate object, as well as the absence of a property division agreement or court decision.
As a result of such actions, the registrar of the territorial community’s budget incurred more than UAH 200 thousand in losses in the form of non-payment of share participation contributions for the construction of real estate.
The prosecutors also filed a civil lawsuit in the criminal proceedings in the interests of the territorial community to recover the said losses.
The pre-trial investigation was carried out by investigators of the Police Department No. 2 of the Lviv District Police Department No. 2 of the Main Directorate of the National Police in Lviv region, with operational support provided by the Cybercrime Department in Lviv region of the Cyber Police Department of the National Police of Ukraine.
Note: According to Art. 62 of the Constitution of Ukraine, a person shall be presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved in accordance with the law and established by a court verdict of guilty.
