The prosecutors of the Lviv Regional Prosecutor’s Office sent an indictment to the court against a 47-year-old man from Lviv for abuse of authority (Part 3 of Article 365-2 of the Criminal Code of Ukraine).
It was established that the accused, while in the position of state registrar, in the absence of a decision of the authority on the transfer of property to private ownership and other documents that would confirm such a transfer, illegally made changes to the State Register of Rights regarding the ownership of real estate objects.
As a result, an administrative building with a total area of almost 4,000 square meters in the center of Lviv fell out of state ownership.
At the prosecutor’s request, the aforementioned property was seized.
For reference, we note that the prosecutors sent a lawsuit to the Commercial Court of the city of Kyiv to declare it illegal and cancel the state registration of ownership of real estate.
The pre-trial investigation in the criminal proceedings was carried out by the investigators of the Investigative Department of the Main Department of the National Police of the region, operational support – the Department of Strategic Investigations in the Lviv Region of the SSR of the National Police of Ukraine.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
