Based on the principled position of the regional prosecutor’s office, the Lviv Court of Appeal left unchanged the decision of the court of first instance regarding a person who illegally acquired, kept for the purpose of sale psychotropic substances in particularly large quantities.
It was established that at the end of July 2021, a resident of Stryi, for the purpose of selling narcotic drugs and psychotropic substances, received a parcel in one of the post offices of the city, which contained a psychotropic substance, the circulation of which is prohibited, in particularly large quantities, however, it was later detained by police officers.
By the verdict of the court of first instance, the man was found guilty and sentenced under Part 3 of Art. 307 of the Criminal Code of Ukraine up to 9 years of imprisonment with confiscation of property.
In the filed appeal, the defense attorney requested the court’s verdict to be annulled and the proceedings to be closed due to the innocence of her client.
After checking the legality and sufficiency of the evidence collected in the case, the appeals court rejected the appeal of the defense, and the verdict of the court of first instance remained unchanged.
