The head of a public organization from Lviv Oblast was sentenced to 5 years in prison for transporting conscripts across the border

The Lviv Regional Prosecutor’s Office appealed the decision of the court of first instance for the head of the public organization in the Court of Appeal. He was found guilty of illegally transporting conscripts across the state border, official forgery and bribery of an official (Part 2 of Article 332, Part 1 of Article 366, Part 3 of Article 368-3 of the Criminal Code of Ukraine).

By the judgment of the district court, he was sentenced to 5 years of imprisonment, he was banned from holding managerial positions for 3 years and fined 51,000 hryvnias, but he was released from serving the sentence with a probationary period.

Disagreeing with this decision, the prosecutors, considering the sentence too lenient for such a crime, appealed it.

It was proven in court that the employee contributed to the illegal transportation of conscripts across the state border.

For this purpose, the convict drew up and submitted relevant documents to the Lviv Regional Military Administration. He asked them for permission to travel outside the conscript’s country as a volunteer for the organization.

After receiving the appropriate permission, information about the conscript was entered into the “Shlyah” system. In this way, conscripts went abroad under the guise of volunteer drivers from a public organization.

It is documented that 24 men went abroad in this way and did not return.

The court supported the position of the prosecution and passed a new verdict. According to which the person involved was sentenced to the actual measure of punishment – 5 years of imprisonment, banned from holding managerial positions in public organizations for 3 years and fined in the amount of UAH 68,000.
