The administrative board of the Western interregional territorial branch of the Antimonopoly Committee of Ukraine established the fact of collusion between the natural person – entrepreneur I. B. Bobrovsky and the natural person – entrepreneur G. Ya. Lepetska during the preparation and participation in the purchase of gazebos, children’s play sandboxes, benches, information boards and stands, held by the regional communal specialized forestry enterprise “Galsillis” (Lviv region) in 2019.
An analysis of a number of factual data established by the Department relating to these trades testified to the presence of signs of a conspiracy by the FOP Bobrovskyi I.B. and FOP Lepetska G.Ya. during preparation and participation in bidding. In particular, the Department found that both business entities, contrary to the Law of Ukraine “On Public Procurement”, actively contacted each other and even used a common phone number during the two procurements, had common IP addresses, etc.
In connection with these and a number of other signs of coordination of behavior between bidders, the Administrative Board of the Western MTV on July 20, 2023 recognized the FOP of Bobrovsky I.B. and FOP Lepetska G.Ya. involved in the violation of the legislation on the protection of economic competition – committing anti-competitive concerted actions that led to the distortion of the results of the auctions. For the conspiracy against FOP Lepetska G.Ya. a fine of UAH 20,000 was imposed.
FOP Bobrovsky I.B. ceased business activity, and therefore it is not possible to impose a fine on him.
We remind you that, according to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for anti-competitive concerted actions related to the distortion of tender results during the last three years .
