The prosecutors discovered an illegal decision of the village council, which, not having the appropriate powers and contrary to the law, illegally disposed of the forested lands of 1 group of state property located in the village. Bryukhovychi, and transferred to the State Enterprise “Lviv Forest Selection and Seed Center” for permanent use. With its illegal decision, the council alienated land plots with a total area of more than 4.23 hectares from the economic entity.
The head of the Galician district prosecutor’s office of the city of Lviv, having discovered a violation, appealed to the court of first instance with a demand to return the above-mentioned plots. However, the court refused to satisfy the claims.
Thanks to the principled position of the prosecutor’s office, the appellate court agreed with the arguments and canceled the decision of the court of first instance, satisfying the prosecutor’s claims in full.
Currently, measures are being taken to ensure the actual execution of the court decision.
