The appellate court upheld the appeal of the Lviv Regional Prosecutor’s Office. The latter canceled the illegal decision of the Sokal District Court of the Lviv Region regarding the recognition of the ownership of a self-constructed non-residential building.
We are talking about the premises, which is located within the coastal strip.
It was established that in 2003, the defendant was given a 30-year lease of a plot of land for the purpose of fishing. The defendant illegally built a non-residential building on it. Later, after the completion of construction, she produced a technical passport and registered the right of ownership.
However, the architectural and construction control body did not issue a permit for the construction of the above-mentioned facility.
Under these circumstances, the Lviv Court of Appeal agreed with the prosecutor’s arguments about the existence of grounds for annulling the previously adopted illegal decision of the court of first instance.
