The Lviv Court of Appeal upheld the decision of the court of first instance. The latter satisfied the lawsuit of the Pustomitivska District Prosecutor’s Office on the claim for the illegal possession of an individual of immovable property, as well as the cancellation of the state registration of the right to private ownership of it.
We are talking about an apartment with a total area of almost 65 square meters, which is located in Lviv. Its cost is almost UAH 1.2 million.
It was established that in 2021, the state registrar carried out state registration of the right to private ownership of the above-mentioned property on the basis of a forged donation contract.
Later, the “owner” alienated this apartment, based on the sales contract.
Thus, as a result of illegal actions of the state registrar of communal property of the territorial community of the city of Lviv, the specified apartment was illegally removed.
For reference, we note that prosecutors sent an indictment to the court against the state registrar. He is charged with abuse of official authority and unauthorized change of information processed in automated systems by a person who has access to it (Part 3 of Article 365-2, Part 3 of Article 362 of the Criminal Code of Ukraine). The trial is ongoing.
