Under the procedural guidance of the prosecutors of the Frankiv District Prosecutor’s Office of the city of Lviv, an indictment was sent to the court against a local resident on the facts of the production and use of forged official documents, as well as fraudulent possession of a land plot (Part 3 of Article 358, Part 4 of Article 358, Part 4 Article 190 of the Criminal Code of Ukraine).
The pre-trial investigation established that the accused produced and used forged official documents, namely: a technical passport and a conclusion on the technical possibility of dividing a residential building in the city of Lviv into two separate independent manor houses. Subsequently, the defendant misled the local self-government body regarding the legality of her actions, as a result of which a land plot with an area of 0.0927 hectares was transferred to her by a decision of the Lviv City Council, which caused the territorial community of the city particularly large material losses in the total amount of more than 2.2 million UAH
According to the principled position of the prosecutors, the court imposed an arrest on the above-mentioned land plot.
In addition, in the course of representative activities, the head of the Frankiv District Prosecutor’s Office of the city of Lviv filed a lawsuit in the interests of the state to invalidate the resolution of the LMR, which transferred ownership of a plot of land to the accused and to cancel the registration of the ownership right to it.
The pre-trial investigation in the criminal proceedings was carried out by the investigators of the JI of the Police Department No. 2 of the Lviv District Police Department No. 2 of the Provincial Government of Ukraine in the Lviv region.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
