Court returns 750 m² of land on Pohulianka Street to the Lviv community

In Lviv, by court decision, a land plot of 750 m² on Pohulianka Street in the historic part of the city will be returned to the territorial community. The claim was filed by the Halytskyi District Prosecutor’s Office of Lviv.

Prosecutors established that the Lviv City Council had leased this plot to a commercial company for a period of 10 years for the construction and maintenance of a multi-flat residential building.

The basis for transferring the land without mandatory competitive bidding was the presence on it of a garage and a shed belonging to the company. At the same time, the area of the allocated plot was almost 23 times larger than the area of this property and was in fact free from development.

In addition, the company concluded a joint activity agreement with residents of the neighbouring building, which provided for the construction of a multi-storey block of flats next to an architectural monument of local significance and the subsequent distribution of the flats.

The court agreed with the prosecutor’s arguments, declared the lease agreement invalid and fully upheld the claim. Once the decision becomes final, measures must be taken to ensure its effective enforcement.
