The administrative board of the Western interregional territorial branch of the Antimonopoly Committee of Ukraine established the existence of a conspiracy between the individual entrepreneur Kolesnik O. M. and the individual entrepreneur Lanitsa O. S. during the preparation and participation in three procedures for the procurement of medicinal products. They were conducted in 2018-2020 by medical institutions of Lviv and Chernivtsi regions.
The department found out that FOP Kolesnik O.M. and FOP Lanitsa O.S. coordinated their actions during the preparation and participation in the auction, contrary to the Law of Ukraine “On Public Procurement”. This is evidenced, in particular, by the synchronicity of the defendants’ actions, the use of the same IP addresses when submitting tenders, common properties of files, etc.
In connection with these and other discovered facts, on July 13, 2023, the Administrative Board of Western MTV recognized the actions of FOP Kolesnik O.M. and FOP Lanitsa O.S. violation of the legislation on the protection of economic competition in the form of anti-competitive concerted actions that led to the distortion of the results of the auctions.
According to the Law of Ukraine “On Public Procurement”, the reason for refusal to participate in the procurement procedure is the fact that the business entity (participant) has been prosecuted for anti-competitive concerted actions related to the distortion of tender results during the last three years.
