An obstetrician-gynecologist from the Lviv region was on trial for the death of the baby

Under the procedural leadership of the Lviv Regional Prosecutor’s Office, an indictment was sent to the court against a 38-year-old woman for failure to fulfill her professional duties by a medical worker as a result of negligent treatment of them, which caused serious consequences for a minor (Part 2 of Article 140 of the Criminal Code of Ukraine).

The pre-trial investigation established that the accused, as an attending physician, performed antenatal outpatient examination and observation of a pregnant woman, as well as hospitalized her and received childbirth.

However, contrary to the requirements of the legislation, the grounds available to the pregnant woman, which refer her to the obstetric and perinatal risk group, as well as the latter’s complaints about the deterioration of the sensations of fetal movements, did not refer her to the department of pathology of pregnant women.

Also, having all the available conditions and opportunities, she did not assess the change in the condition of the fetus, when conducting the appropriate research and gynecological examination. And during the hospitalization of the pregnant woman and her delivery, she did not diagnose and did not establish the existing diagnosis.

As a result, the obstetrician-gynecologist did not make a timely decision to change the delivery tactics, which led to the birth of a child in a critical condition.

As a result, in April 2021, three days after birth, the baby died.

The pre-trial investigation was carried out by the investigators of the State Department of the State of Ukraine in the Lviv region.

Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
