The Commercial Court of Lviv Region has upheld a claim by the Frankivsk District Prosecutor’s Office of Lviv to recover an apartment for the territorial community of the city, which had been unlawfully transferred into private ownership.
The case concerns a municipal apartment in the Zaliznychny District of Lviv. The apartment has an area of 28.1 square meters and is valued at 1 million UAH.
Case Details
It was established that the property was municipal housing and had never been privatized. The previous tenant had used the apartment under a tenancy order. However, after her death, the apartment was unlawfully transferred to a private individual, even though it officially remained in community ownership.
A falsified purchase agreement, allegedly executed at a commodity and stock exchange, was used to transfer ownership. Once the new “owner” obtained the title, the apartment was contributed to the charter capital of their business.
Prosecutorial Action
Responding to these violations, the prosecutor’s office filed a lawsuit, which the court upheld. After the court decision comes into force, steps will be taken to promptly enforce it and return the apartment to the ownership of Lviv’s community.
