The Lviv Regional Prosecutor’s Office ensured the real implementation of court decisions on reclaiming land from the illegal private property of an individual in favor of the state.
A land plot for forestry purposes with a total area of more than 0.2 hectares was returned to the state. It is located in the village. Bryukhovychy cities of Lviv.
It was established that the village council, contrary to the law, disposed of state-owned lands, which were under the right of permanent use of the “Lviv Forest Selection and Seed Center” branch of the State Specialized Economic Enterprise “Forests of Ukraine”.
By its decision, the village council alienated land plots from the forest fund. Later, these lands were illegally acquired by a natural person.
The prosecutor’s office filed a claim for land plots, which was upheld by the district court. However, in order to avoid such execution, the defendant merged the lands into one.
Accordingly, the prosecutors filed a lawsuit to claim the newly formed plot, which was also approved, and later left unchanged by the Supreme Court.
The above-mentioned court decision was implemented – the land plot was returned from private ownership and registered with the Lviv Regional State Administration.
