On July 6, 2023, the administrative board of the Western interregional territorial branch of the Antimonopoly Committee of Ukraine made a decision to recognize certain actions of the private joint-stock company “Lvivoblenergo” as abuse of a monopoly position.
A private joint-stock company appealed to the Department and stated that PJSC “Lvivoblenergo” unreasonably applied the tariff for services for the distribution of electric energy according to the second voltage class (which is significantly higher than the tariff for distribution services according to the first voltage class) for the applicant. Such actions of the enterprise are not provided for by the current legislation of Ukraine, in particular, the Law of Ukraine “On the Electric Energy Market” and the Procedure for Setting Tariffs for Electricity Distribution Services and led to the infringement of the interests of the consumer, who has no alternative for receiving these services.
In view of the mentioned circumstances, the Administrative Board of the Western MTV of the AMCU recognized the actions of PJSC “Lvivoblenergo” as a violation of the legislation on the protection of economic competition, fined the company UAH 68,000 and ordered it to stop and eliminate the consequences of the violation within a month.
