The Court of Appeal rejected the complaints of garage cooperatives regarding the creation of the Landscape Reserve “Torfovishche Bilogorshcha” in the Lviv region

Today, the Eighth Administrative Court of Appeal rejected the appeals of the garage cooperatives, which tried to challenge the decision of the Lviv Regional Council on the creation of the “Torfovishche Bilogorshcha” Landscape Reserve. This was announced by the head of the legal department of the Lviv Regional Council, Yaroslav Hasyak.

The reserve of local importance “Torfovishche Bilogorshcha” was created by the regional council on October 29, 2019. And in 2020, the Ryasne-Ruska village council decided to transfer 15 hectares of the landscape reserve to private ownership.

After conducting a land inventory, which took place in connection with the joining of the Ryasne-Ruska village council to the Lviv city council, it turned out that several garage cooperatives received part of the land of the reserve free of charge. These cooperatives as legal entities were created already after the land was announced by the reserve, during August-September 2020, a month before receiving the land.

In January 2022, these garage cooperatives filed a lawsuit with a demand to cancel the decision of the Lviv Regional Council on the creation of the Biloghorsh Peatland reserve.

On July 19, 2023, the Lviv District Administrative Court made a final decision in the case of the “Torfovishche Bilogorshcha” nature reserve, recognizing the decision of the Lviv Regional Council to establish it as legal.

The lawsuits brought together the Lviv Regional Council, the Lviv City Council, the Zymnovodsk Village Council, the Lviv Regional Prosecutor’s Office, the Ministry of Environmental Protection and Natural Resources of Ukraine, representatives of the Committee of the National Association of Lawyers of Ukraine on Land, Agrarian and Land Law, the public and residents. of Lviv, who gathered the necessary number of votes for the petition to preserve the unique natural area as a place of rest for the people of Lviv.
