After the creation of Lviv MTG, the city turned to law enforcement agencies, a criminal case was opened. However, the arrest imposed on the land plot was recently lifted, and the developer immediately began work.
Yes, without permits for landscaping and cutting down trees, they have already started cutting down trees and installing a fence here. But thanks to the joint work of the Shevchenkiv district administration and the police, the work was suspended last night. This was told by the deputy mayor for urban planning, Lyubomyr Zubach, during a working visit to Bryukhovychi.
“This scam was carried out by the Bryuhovytsk settlement council before the 2020 elections. The premises of the school were written off, and the plot of land was given free of charge to a public organization for further construction. When we created the Lviv MTG, of course, we did not accept this scam, but turned to the law enforcement authorities, and a criminal case was opened. It was investigated for some time, but as it turned out, the necessary dynamics are not there. And about 2 weeks ago, the arrest imposed on this plot of land was lifted. Accordingly, people who wanted to implement this project decided to continue this process. We object to such intentions and will do everything possible, both in the legal sphere and in the sphere of common sense, to prevent the implementation of this scam,” said Lyubomyr Zubach.
It is interesting that yesterday the developer voluntarily paid the city 250,000 hryvnias of restoration value for the trees on this site. While the city’s Department of Ecology and Natural Resources did not make such calculations and did not issue an order to cut trees. At the same time, the head of the department Oleksandra Sladkova notes that this amount is very low. Considering the amount, it is suspected that the developer wants to cut down all the trees on the site. “There are the remains of a park here, which most likely was a part of B. Khmelnytskyi’s park. After all, there are decorative and very beautifully formed trees here, which could not have appeared by themselves. The replacement value of such decorative trees, hundred-year-old oaks can be 20-30 thousand UAH, sometimes even 50-80 thousand UAH per tree. We do not know on the basis of which documents the builders paid such a restoration amount for planting. Our main goal is to preserve the most valuable trees,” said Oleksandra Sladkova.
Yurii Lukashevskyi, the head of the city agglomeration department of the LMR, believes that this plot could have been sold through an auction and the construction of the existing school in Bryukhovychy could have been completed with the recovered funds. “The kindergarten also needs expansion. I am convinced that these funds would be sufficient for this. But, unfortunately, the former village council wrote off the unfinished school building, and donated the plot of land to a public organization and gave permission to build housing there. I believe that to implement this project during the war is a double insult: both to the community and to the state,” Yuriy Lukashevsky said.
Considering all the violations, today the issue of construction in Bryukhovychy will be considered by the city commission on TEB and Emergency Situations.
