Under the procedural guidance of the prosecutors of the Galician District Prosecutor’s Office of the city of Lviv, the pre-trial investigation was completed and an indictment was sent to the court against the former official of the Department of Capital Construction of the LODA for official negligence (Part 2 of Article 367 of the Criminal Code of Ukraine).<\/p>\n
The pre-trial investigation established that between the capital construction department and one of the enterprises additional agreements were concluded to the contract regarding the reconstruction of the Lviv Regional Clinical Perinatal Center for the purchase of medical equipment with a total cost of over UAH 27 million.<\/p>\n
However, despite the fact that in accordance with the current legislation of Ukraine, adopted in the context of the coronavirus disease pandemic, transactions for the purchase of half of the above-mentioned devices were exempt from VAT taxation, the administration purchased it with an unjustified payment of VAT.<\/p>\n
Thus, as a result of the official negligence of the temporary head of the capital construction department, more than UAH 804,000 VAT was overpaid, as a result of which the state, represented by the capital construction department of the Lviv regional state administration, suffered material damage (damages) in the specified amount.<\/p>\n
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.<\/p>\n
