The prosecutor’s office systematically takes measures to fulfill the powers provided for by the Constitution of Ukraine and the Law of Ukraine “On the Prosecutor’s Office” to establish a violation of the state’s interests during the transfer of communal property into private ownership.<\/p>\n
Thus, the Galician District Prosecutor’s Office of the city of Lviv studied the legality of the premises of the House of Scientists being privately owned.<\/p>\n
Having studied and analyzed the documentation received at the request of the prosecutor’s office, the head of the district prosecutor’s office submitted a lawsuit to the Economic Court of Lviv region for the claim of illegal possession of the premises of the House of Scientists.<\/p>\n
As the head of the prosecutor’s office reported, it was established that, contrary to current legislation, the above-mentioned building is privately owned by the Lviv Regional Organization of the Trade Union of Education and Science Workers of Ukraine, although the building belongs to the list of monuments that are not subject to privatization. In fact, the building of the House of Scientists is used for profit, which contradicts the concept of a non-profit organization.<\/p>\n
In addition, it was established that the premises belonged to the regional communal property and there were no legal grounds for the adoption of an order by the district administration on its transfer to private ownership.<\/p>\n
Thus, the decision to transfer property was made in violation of the requirements of the Civil Code, the Law of Ukraine “On Property”, the Law of Ukraine “On Trade Unions, Their Rights and Guarantees of Activity”.<\/p>\n
The prosecutor’s office in court will insist on the return to the community of the specified real estate in the very center of Lviv with a total area of \u200b\u200bmore than 3,200 square meters. m.<\/p>\n
Such a principled position of the prosecutor’s office will make it impossible in the future to hold dubious mass events in the historical monument of the city of Lviv, such as the youth party that took place in November last year and gained wide negative resonance in the mass media.<\/p>\n
