The court upheld the position of the Pustomyty District Prosecutor’s Office in Lviv region and satisfied the claims in full, ordering the unscrupulous developer to reimburse the debt of almost UAH 2.5 million in equity participation.<\/p>\n
Prosecutors proved in court that in 2021, the developer commissioned two residential buildings in Pustomyty (Lviv region).<\/p>\n
According to the law, the construction company was obliged to enter into a share participation agreement with the local government and pay a share contribution to the local budget.<\/p>\n
However, the developer did not enter into the agreement and did not transfer the above funds to the local budget for the creation and development of social, engineering and transport infrastructure of the settlement.<\/p>\n
As a result, the local government is deprived of the opportunity to use these funds for the construction of infrastructure and social facilities, including educational institutions, preschools, parks and playgrounds in the territory of the Pustomyty territorial community.<\/p>\n
In order to protect the interests of the community, the prosecutor’s office filed a lawsuit to recover this amount from the company.<\/p>\n
