The property in question is a building with a total area of almost 250 square metres located in Lviv.<\/p>\n
It was established that, based on a court order approving the settlement agreement, the company illegally transferred ownership of the real estate allegedly owned by it to the plaintiff, which was registered in the State Register of Real Property Rights. However, the company was not the owner of the disputed property, but only a lessee, and, accordingly, had no right to dispose of it. Thus, the said monument of cultural heritage of local significance was unlawfully withdrawn from the municipal property of the territorial community of Lviv.<\/p>\n
In response to the violation, prosecutors proved that the defendant’s acquisition of ownership of the building was unjustified.<\/p>\n
Therefore, the Economic Court upheld the claim for reclamation of real estate from illegal possession.<\/p>\n
