Prosecutors of the Lviv Regional Prosecutor’s Office sent to court an indictment against six members of an organized group. They are charged with abuse of office (Part 3 of Article 28, Part 2 of Article 364 of the Criminal Code of Ukraine).<\/p>\n
The investigation established that a deputy of one of the village councils in Lviv region, while serving as the head of the village council’s land commission, organized the illegal allocation of land plots in favor of third parties.<\/p>\n
The land in question is located on the projected part of a road near Lviv. The road construction project envisages a traffic interchange. Therefore, such land cannot be granted into private ownership.<\/p>\n
For this purpose, he engaged three other employees of the same village council, as well as the director of a private land management organization and the state registrar of one of the territorial communities of Lviv district.<\/p>\n
The organizer found people from among his relatives who had the right to acquire land within the community free of charge. Then, without their knowledge, he applied to the village council with forged applications for permission to allocate land to them.<\/p>\n
The accomplices from the village council approved these permits and, together with the organizer, ensured a positive vote of the village council commission on the allocation of these plots.<\/p>\n
After that, the director of the private enterprise developed land management projects without the actual presence of the customers, and the state registrar registered the illegally registered land for agriculture.<\/p>\n
As a result, three land plots with a total value of UAH 2.7 million were transferred out of communal ownership.<\/p>\n
At the request of the prosecutor, the above plots were seized.<\/p>\n
The pre-trial investigation was carried out by investigators of the Territorial Department of the State Bureau of Investigation in Lviv, the operational support was provided by the Territorial Department of the State Bureau of Investigation in Lviv.<\/p>\n
Note: In accordance with Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.<\/p>\n
