Represented by the Lviv Regional Prosecutor’s Office, the court upheld the claim of the head of the Zhovkva District Prosecutor’s Office to recover from the defendant almost UAH 500 thousand of rent, i.e. unjustifiably retained funds for the use of a land plot.<\/p>\n
It was established that one of the local enterprises owns real estate on the above-mentioned land plot. In particular, a complex of buildings with a total area of almost 925 m2 is located on this land.<\/p>\n
This is a plot of land with a total area of over 0.4 hectares located in Zhovkva. Its intended purpose is the placement and operation of main, auxiliary, and auxiliary buildings and structures of construction organisations and enterprises.<\/p>\n
However, the owner of the property did not properly register the right to use the land plot, which is in communal ownership. He used it without the relevant title documents, namely without entering into a land lease agreement.<\/p>\n
Accordingly, this resulted in the local budget not receiving funds in the form of rent.<\/p>\n
These violations gave rise to a lawsuit filed by the prosecutors, which was fully satisfied by the Commercial Court.<\/p>\n
The appeal against this decision is currently underway.<\/p>\n
