The Commercial Court initiated proceedings under a claim filed by the Frankivsk District Prosecutor’s Office of Lviv against a business entity and a municipal enterprise. The prosecutors are seeking to invalidate additional agreements to the supply contract. They also want to recover the overpaid money.<\/p>\n
Prosecutors have established that in 2021, following a tender, a diesel fuel supply agreement was concluded between a Lviv municipal enterprise engaged in passenger transportation and a company.<\/p>\n
During the term of the contract, the customer and the supplier signed 49 additional agreements to the contract, which artificially changed the price per unit of goods. In particular, under 47 of them, the price per unit of goods was higher by more than 10% of the value determined by the terms of the contract, and in a certain period of time it increased for the utility company by more than 173% of the price determined by the contract.<\/p>\n
Thus, as a result of the unjustified increase in the price of diesel fuel, the company was unlawfully transferred almost UAH 65 million.<\/p>\n
This was the reason for the prosecutors to file a lawsuit with the court.<\/p>\n
The court proceedings are ongoing.<\/p>\n
