The land in question is a 2-hectare area located on the territory of the Sokal city community. The land plot is located along the state border of Ukraine, so it belongs to defence land and can only be owned by the state.<\/p>\n
It was established that the disputed land plot was illegally transferred to communal ownership under orders of the Main Department of the StateGeoCadastre. It was classified as agricultural land. Whereas under current legislation, the right to dispose of defence land belongs exclusively to the state, represented by the regional state administration.<\/p>\n
This gave rise to a lawsuit filed by the prosecutors, which was upheld by the court of first instance and upheld on appeal.<\/p>\n
The court’s decision has now been enforced – the State Register of Real Property Rights has been updated to register the state ownership of the land plot with the Lviv Regional State Administration.<\/p>\n
