The court supported the position of the Lviv Regional Prosecutor’s Office and satisfied the claims of the Halytskyi District Prosecutor’s Office of Lviv city. The developer was obligated to recompense the debt for the payment of the equity participation amounting to almost 6 million UAH.<\/p>\n
Prosecutors established that in 2019 the construction company started the construction of multi-apartment buildings in the Shevchenkivskyi district of Lviv. According to the legislation, the company was obligated to sign an equity participation agreement with the local government authority and pay the equity contribution to the local budget.<\/p>\n
However, the developer failed to fulfill the obligation and did not transfer the aforementioned funds to create and develop the social and engineering-transport infrastructure of the settlement to the local budget. In order to protect the interests of the community, the prosecutor’s office filed a lawsuit to recover this amount from the company, which was satisfied by the court.<\/p>\n
