Under the procedural leadership of the Lviv Regional Prosecutor’s Office, the acting director of one of the communal enterprises of the Sambir district was notified of the suspicion. He is accused of abuse of official position, which caused serious consequences (Part 2 of Article 364 of the Criminal Code of Ukraine).
According to the investigation, in 2022, the suspect concluded contracts for road repair works in the city of Sambori with the mother of a subordinate employee of a utility company, who also works at the same company as a janitor.
The total amount of contracts is one and a half million hryvnias.
For this purpose, the person involved organized the registration of the above-mentioned relative as a FOP. After that, contrary to the law, he divided the street repair into separate retail contracts and concluded the relevant contracts with her as a contractor without holding open tenders.
At the same time, the man reliably knew that this “entrepreneur” did not have the experience and means to fulfill the terms of the contract.
Subsequently, he engaged subordinate workers and equipment for repair work free of charge.
After that, he signed the acts of acceptance of the completed works, which indicated information about the works that were not actually performed and the materials that were not actually used.
Accordingly, on the basis of these documents, funds were transferred from the city budget to the contractor’s account.
Currently, the issue of selecting a preventive measure for the suspect and removing him from his position is being resolved.
Investigations are ongoing, all persons involved in the crime are being identified.
The crime was exposed by the prosecutor’s office together with the investigators of the Main Directorate of the National Police in the Lviv Region, operational support was provided by the Strategic Investigations Department in the Lviv Region of the National Police of Ukraine.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
