
The Western Court of Appeal confirmed the community’s right to two plots of land in the ‘Torfovysche Bilogorscha’ sanctuary.
The court upheld the decision of the first instance, which satisfied the lawsuits of the Frankivsk District Prosecutor’s Office of Lviv. The matter concerns plots of over 6 hectares located within a local landscape sanctuary. Prosecutors proved that the Riasne-Ruska village council illegally transferred these lands to garage-building cooperatives.
**Nature reserve lands** cannot be used for the construction and operation of automobile transport facilities. The prosecution demanded the annulment of the village council’s decisions and the cancellation of state registration of property rights on the plots. The first instance court satisfied these demands.
The defendants appealed the decision, but the appellate court supported the prosecutors’ position. Previously, the Economic Court of the Lviv region had satisfied 5 lawsuits regarding the annulment of decisions on land transfers. The total area of the disputed lands exceeds 15 hectares.
