As reported by the City Inspectorate of the State Arch-Building Control, the 5th floor of the multi-apartment residential building on the street was voluntarily completed by Ferozit LLP. Varshavska, 112 is being dismantled. According to the court decision, all expenses related to its removal will be compensated by the developer.
Back in 2018, the State Architectural and Building Control Inspectorate filed a lawsuit in court, with a demand to oblige Ferozit LLP to bring the facility at 112 Varshavska Street into compliance with the issued town planning conditions and restrictions.
“In simple words, the developers added an “extra” floor. Court proceedings lasted for a long time until the final decision was made to demolish the illegal extension. Now this decision is already in the executive service,” said Taras Pavlyshyn, director of the Lviv DABC Inspection.
Thus, by the decision of the Supreme Court on July 14, 2021, the cassation appeal of Ferozit LLP against the decision of the Eighth Administrative Court of Appeal dated May 17, 2021 was returned to the complainant. Therefore, the last court decision was the decision of the Ternopil District Administrative Court dated September 27, 2022.
It is known that on November 11 of this year, the Shevchenkiv Department of the State Executive Service in Lviv opened proceedings in this case.
