
The Commercial Court of Lviv Region satisfied the prosecutor’s claim for the return of the land plot to the community.
The court declared the village council’s decision to allocate the land plot for use as illegal. It was ordered to cancel the state registration of permanent land use rights and return it to the community.
The prosecutor’s office established that in 2020 the Bryukhovychi village council unjustifiably allocated the land to one of the enterprises. The land, with an area of almost 3.5 hectares, was designated for a rehabilitation center for military personnel.
However, the documents indicated that the rehabilitation center would occupy only 1% of the development area. This became the basis for the lawsuit, which was fully satisfied.
