Lviv City Hall to challenge DIAM construction permit for Olesnytskoho Street in court

Lviv City Council is preparing a legal action to overturn the decision of the State Inspectorate for Architecture and Urban Planning of Ukraine (DIAM) to grant a permit for the construction of a multi-flat residential building at 1 Yevhena Olesnytskoho Street in Lviv.

The case concerns a five-storey building in Levandivka, which the municipal inspectorate for state architectural and construction control had previously classified as unauthorised construction. The inspectorate fined the developer and issued an order for the demolition of the property.

According to the municipal SACI, part of the building was erected by the housing construction cooperative “Levan-Lend” on its own plot of land, but without the necessary permits. In particular, the construction was carried out without duly issued urban planning conditions and restrictions, in a low-rise development zone Zh-1, and the project documentation was handed over to the client in breach of legal requirements.

As regards water supply and sewerage, the cooperative, according to the inspectorate, resolved these issues at the expense of a neighbouring single-storey house, having concluded a dubious contract with its owner. The state registers also contain no permits from the services responsible for the gas supply to the building, which is a mandatory requirement for such a property. The municipal SACI notes that this is only part of the violations identified, and the full list is considerably longer. It was for this reason that at the beginning of 2026 the inspectorate first imposed a fine on the cooperative and later issued an order for the demolition of the building.

At present, the building at 1 Yevhena Olesnytskoho Street is in an unfinished state: five storeys have been erected, the monolithic frame has been completed and part of the external walls have been built, the construction site is fenced off, and there is existing residential development nearby.

The Deputy Mayor for Urban Planning, Liubomyr Zubach, stressed that the preparation of a claim against DIAM seeking to annul the permit issued is, in his words, the first such case in Ukraine, as there have been no such precedents in domestic judicial practice before.
