
Lviv City Council has filed a claim with the Lviv District Administrative Court seeking to overturn the permit issued by the State Inspectorate for Architecture and Urban Planning of Ukraine (DIAM) for the construction of a multi-storey residential building at 1 Ye. Olesnytskoho Street in Lviv. The filing of the claim was announced by the Deputy Mayor for Urban Planning, Liubomyr Zubach.
The case concerns an unfinished multi-flat residential building: six storeys have already been constructed on the site, the monolithic frame has been completed and the brick exterior walls have been partially built, and the area around the site is fenced off.
According to the city inspectorate of the State Architectural and Construction Control, this construction had previously been recognised as unauthorised. The developer was fined more than UAH 522,000 and was served with an order to demolish the building.
The client for the works is the service cooperative “Housing Construction Cooperative “Levan Land””. After the intervention of the city monitoring bodies, the cooperative applied to DIAM. The State Inspectorate approved a change in the consequences class of the building to CC3 — the highest level of liability and complexity, which applies to buildings where an accident could result in mass casualties, significant economic losses or serious environmental consequences. Following this, the inspectorate issued a permit for construction works.
The City Council points out that the permit was granted at a time when the building had in fact already been erected.
“Since the beginning of this year in Ukraine, only individuals can lodge complaints about construction. But if, for example, an illegal construction is discovered by the City Council, no one takes this ‘discovery’ into account. A local self-government body cannot apply to that very line ministry or to DIAM. But, as the case on Olesnytskoho shows, the situation can be even worse: instead of an inspection we get a full permit, by which an ‘unauthorised build’ is turned into a ‘lawful construction’. That is precisely why at the end of September Lviv City Council went to court. We are asking the Lviv District Administrative Court to cancel the construction permit on Olesnytskoho issued by DIAM,” said Liubomyr Zubach.
As City Hall recalls, the city inspectorate uncovered the illegal construction at 1 Olesnytskoho Street back in December 2025. The inspection at that time found that five storeys of the building had already been constructed without the necessary permits from the city authorities.
It was previously reported that the State Inspectorate for Architecture and Urban Planning of Ukraine had introduced an online service for appealing refusals to issue urban planning conditions and restrictions. At the time, Liubomyr Zubach noted that, in his view, such changes reduce the influence of local self-government bodies over control of urban development.
