According to the principled position of the prosecutors of the Drohobych district and Lviv regional prosecutor’s offices, the court of appeal overturned the verdict of the court of first instance against the 34-year-old resident of Drohobych. He was found guilty of violating traffic safety rules by a person who drives a vehicle while intoxicated, which caused serious bodily harm to the victim (Part 2 of Article 286-1 of the Criminal Code of Ukraine).
It was established that in February 2022, in the evening, the convict was in a state of alcohol intoxication, driving a passenger car and causing a traffic accident.
Moving along one of the streets of Drohobych, in the direction of the exit from the city, the man exceeded the permissible speed within the limits of the settlement, drove into the opposite lane of the road and collided with a car.
As a result, the driver of the oncoming car received serious injuries, and his passengers received moderate and light injuries.
By the verdict of the district court, the accused was found guilty of committing a traffic accident and sentenced to 5 years of imprisonment with the deprivation of the right to drive a vehicle for 2 years. However, the court unjustifiably excluded the state of alcohol intoxication from the accusation and set a probationary period of 3 years.
The prosecutors did not agree with such a decision of the court and challenged it in the appellate procedure, insisting on the appointment of a real and not a conditional punishment.
After hearing the position of the prosecutor, the appeals court canceled the verdict of the court of first instance and adopted a new one. The latter’s criminal-legal qualifications were changed and a sentence of 3 years and 6 months of imprisonment was imposed. And also deprived of the right to drive vehicles for 6 years.
