Court of Appeal returns non-residential premises in Frankivskyi District to the Lviv community

The Court of Appeal has returned to municipal ownership non-residential premises in Lviv’s Frankivskyi District worth over UAH 300,000, confirming the community’s title to this property.

Prosecutors of the Lviv Regional Prosecutor’s Office established that, when the building was transferred to the community, a basement unit was unlawfully removed from municipal ownership. According to the agency, on the basis of fictitious documents it was initially unjustifiably attached to a private flat and was later re-registered and sold on.

The violations identified formed the grounds for the Frankivskyi District Prosecutor’s Office of the city of Lviv to bring the case to court. As a result, the court of appeal overturned the unlawful decision of the district court and upheld the prosecutor’s position that there were no legal grounds to extend the boundaries of private ownership at the expense of property belonging to the Lviv community.
