Under the procedural guidance of the prosecutors of the Frankiv District Prosecutor’s Office of the city of Lviv, a 46-year-old resident of the Lviv region was informed of the suspicion of abusing his powers as a state registrar and unauthorized change of information processed in automated systems (Part 3 of Article 365-2, Part 3 of Article 362 of the Criminal Code of Ukraine).
According to the investigation, the suspect, while in the position of state registrar, with the aim of obtaining an illegal benefit for himself and one of the Lviv companies, in the absence of legal documents, made changes to the State Register of Rights regarding the ownership of real estate objects, namely non-residential premises in general with an area of 79.4 square meters, located in the center of Lviv.
As a result, non-residential premises with a market value of more than UAH 3.5 million were illegally removed from the communal property of the city council and the private property of a Lviv pensioner.
It should be noted that the measures taken during the pre-trial investigation, based on the lawsuits of the prosecutors of the Frankiv District Prosecutor’s Office of the city of Lviv, the court annulled the illegal decisions of the state registrar and reclaimed the property from someone else’s illegal possession into communal property.
The pre-trial investigation in the criminal proceedings continues, it is being carried out by the investigators of the Lviv District Police Department No. 2 of the Provincial Government of the Lviv Region.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
