Under the procedural leadership of the Yavoriv District Prosecutor’s Office, an indictment against the director of the company was sent to the court. He is charged with taking possession of someone else’s property by abusing his official position and official forgery of official documents (Part 5 of Article 191, Part 2 of Article 366 of the Criminal Code of Ukraine).
The investigation established that the accused took possession of the funds of the utility company.
In December 2022, a contract was concluded between one of the communal enterprises of the Yavoriv district and a private enterprise, according to the terms of which the involved company undertook to supply and in the future to store crushed granite and limestone in a certain amount.
However, the indicated goods were not delivered in the stipulated quantities.
Despite this, the person involved entered false information into the official document – the act of acceptance and transfer, where he significantly overestimated the actual quantity of the delivered goods.
On the basis of the latter, the utility company transferred funds to the business entity.
As a result of such actions, losses in the amount of about 3.5 million hryvnias were caused to the territorial community.
The pre-trial investigation in the criminal proceedings was carried out by the investigators of the Yavoriv district police department of the Main Department of the National Police in the Lviv region under the operational support of the Strategic Investigations Department in the Lviv region of the Department of Strategic Investigations of the National Police of Ukraine.
Note: in accordance with Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
