The head of a state enterprise is suspected of abusing his official position, resulting in losses exceeding 2 million UAH.
Under the procedural guidance of the Lviv Regional Prosecutor’s Office, the head of one of the state enterprises has been notified of suspicion. He is charged with abuse of official position (Part 2, Article 364 of the Criminal Code of Ukraine).
According to the investigation, in 2024, the suspect, abusing his official position, organized the illegal lease of real estate to a private educational institution. Specifically, without conducting an auction and at an understated rate of payment for the use of such property, which belongs to the state ownership.
To achieve this, the man drafted, signed, and sealed with the stamp of the state enterprise he headed a “favorable” Preliminary Agreement for the use of individually defined real estate with the subject. Under this agreement, the educational institution paid only 30% of the total estimated amount determined by the property valuation conclusion. However, the suspect was fully aware that the rental payment is determined by auction results, and also that payment to the budget is made in the amount of 70% of the total estimated amount from the payment for property use.
Thus, more than 2 million UAH of material damage was inflicted on the State Budget of Ukraine. The pre-trial investigation is conducted by detectives of the territorial office of the Bureau of Economic Security in the Lviv region, operational support – the Security Service of Ukraine in the Lviv region.
Note: According to Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in accordance with the law and established by a court verdict.
