Former head of a department of the State Border Control Department of one of the interregional main departments of the State Service of Ukraine for Food Safety and Consumer Protection at the state border will be tried for abuse of influence
Prosecutors of the Lviv Regional Prosecutor’s Office have sent to court an indictment against the former head of a department of the State Border Control Department of one of the interregional main departments of the State Service of Ukraine for Food Safety and Consumer Protection at the state border.
The former head of the State Control Department organised a “hassle-free” customs crossing for USD 50 per truck
He is charged with obtaining an unlawful benefit for himself for influencing the decision-making of a person authorised to perform state functions (Part 2 of Article 369-2 of the Criminal Code of Ukraine).
The investigation established that the defendant organised a criminal scheme to obtain an unlawful benefit.
In exchange for a bribe, the State Service of Ukraine for Food Safety and Consumer Protection official promised to influence officials and thus ensure unimpeded and fast passage of state veterinary and sanitary control of the cargo that the company would import into the customs territory of Ukraine.
A fixed fee of USD 50 per truck was set for each truck.
It is documented that in total, the offender received USD 300 of illegal benefit from the company representative.
The man was detained while receiving the next “tranche” of the bribe.
The civil servant has now been dismissed from his position.
The pre-trial investigation was carried out by the State Bureau of Investigations, based on the materials of the SBU Office in Lviv region.
Note: In accordance with Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and shall not be subjected to criminal punishment until his or her guilt is proved by law and established by a court verdict of guilty.
